Terms of Service

These Terms of Service ("Terms") govern your access to and use of the "My Strategy Is" platform (the "Service"), which is operated by People Products Pty Ltd (ACN 695 301 378), Level 6/241 Commonwealth St, Surry Hills NSW 2010, Australia ("we", "us", "our").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

1. Eligibility

You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you are 18 years of age or older and legally capable of entering into a binding contract.

The Service is intended primarily for business and professional users (such as founders, operators, and strategy teams). You agree that you are using the Service in a professional or commercial context, not as a consumer relying on personal advice.

2. The Service

"My Strategy Is" is an online software platform that provides structured, AI-assisted strategic analysis tools, including the generation of strategy summaries, diagnostic indicators, and validation reports.

The Service is provided on a software-as-a-service (SaaS) basis. Access to certain features (including full validation reports) may require a one-time payment.

We may update, modify, suspend, or discontinue any part of the Service at any time without notice or liability.

3. Informational Use Only — No Advice

The Service provides informational and analytical outputs only. It does not provide financial, legal, investment, professional, or business advice of any kind.

All outputs, including scores, summaries, and assessments, are generated through automated and probabilistic processes. They are intended solely to assist structured thinking and should not be relied upon as the sole basis for any commercial, financial, legal, or strategic decision.

You acknowledge and agree that:

• Outputs may be incomplete, approximate, or inaccurate;
• The Service does not take into account all relevant factors specific to your business or circumstances;
• You remain solely responsible for all decisions made based on any outputs from the Service.

You must obtain appropriate independent professional advice before making significant business or financial decisions.

4. Account Creation and Verification

To access certain features, you may be required to provide and verify your email address. An account is deemed created once your email address is successfully verified, even if no password has been set.

You are responsible for maintaining the confidentiality of any access credentials and for all activity that occurs under your account.

5. Payments and Purchases

Certain features of the Service, including full validation reports, are available for a one-time fee. Pricing is displayed at the point of purchase and may vary by location and currency.

All payments are processed through third-party payment providers. We do not store full payment card details.

By purchasing a report, you agree that:

• The report is generated immediately upon payment;
• Delivery is considered complete once the report is made available in the Service or for download;
• The purchase is a one-time transaction and does not create an ongoing subscription unless expressly stated.

6. No-Refund Policy

Due to the immediate digital delivery and computational generation of reports, all purchases are final.

Once a validation report has been generated and made available, you are not entitled to a refund, except where required by applicable law.

You acknowledge that you have reviewed your inputs and understand the nature of the Service before completing any purchase.

7. User Inputs and Data

You may submit text, strategy descriptions, or other information ("Inputs") to the Service.

You retain ownership of your Inputs. However, you grant us a non-exclusive, worldwide licence to use, store, and process your Inputs solely for the purpose of providing and improving the functionality of the Service.

We store Inputs to deliver the Service and enable report generation. Inputs are not used to train or improve third-party AI models.

You agree not to submit:

• Confidential or proprietary information of third parties without proper authorisation;
• Personal data that is not necessary for the intended analytical purpose;
• Content that is unlawful, misleading, or infringing.

8. Intellectual Property

All intellectual property rights in the Service, including the software, scoring frameworks, methodologies, algorithms, models, visualisations, and underlying structure, are owned by or licensed to People Products Pty Ltd.

You retain ownership of your Inputs.

You are granted a limited, non-exclusive, non-transferable licence to use the outputs and reports generated by the Service for your internal business purposes. You must not resell, sublicense, or commercially exploit the outputs as a standalone product or service without our written permission.

Nothing in these Terms transfers ownership of our intellectual property to you.

9. Acceptable Use

You agree not to:

• Use the Service for any unlawful or fraudulent purpose;
• Upload or analyse data you do not have the right to use;
• Attempt to reverse engineer, copy, or extract the underlying models, scoring logic, or methodologies;
• Interfere with the operation or security of the Service;
• Use the Service to develop a competing product.

We may suspend or terminate access if we reasonably believe you have breached this section.

10. Availability and Changes

We do not guarantee that the Service will be uninterrupted, secure, or error-free. We may modify, suspend, or discontinue any feature or the entire Service at any time without liability to you.

11. AI and Probabilistic Outputs

The Service uses automated and AI-assisted processes to generate analytical outputs. These outputs are probabilistic in nature and may not always be accurate, complete, or suitable for your specific context.

You acknowledge that:

• AI-generated outputs may contain errors or omissions;
• The Service does not replace human judgment or professional expertise;
• You must independently evaluate the appropriateness of any output.

12. Limitation of Liability

To the maximum extent permitted by law, we exclude all liability for any loss or damage arising from your use of, or reliance on, the Service or any outputs generated by it.

This includes, without limitation, any:

• Loss of profits, revenue, business opportunity, or anticipated savings;
• Indirect, consequential, or special loss;
• Strategic, commercial, or investment losses arising from reliance on outputs.

Our total aggregate liability to you for any claim arising out of or in connection with the Service is limited to the amount you paid to us for the relevant report or feature giving rise to the claim.

Nothing in these Terms excludes any liability that cannot be excluded under applicable law.

13. Indemnity

You agree to indemnify and hold harmless People Products Pty Ltd, its directors, employees, and contractors from any claims, damages, losses, or expenses arising from:

• Your misuse of the Service;
• Your breach of these Terms;
• Your reliance on outputs for critical business or financial decisions.

14. Termination

We may suspend or terminate your access to the Service at any time if you breach these Terms or use the Service in a manner that we reasonably consider inappropriate or harmful.

Upon termination, your right to access the Service will cease immediately.

15. Privacy

Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you agree to the practices described in that Privacy Policy.

16. Future Features

We may introduce new features, plans, APIs, or subscription options in the future. Such features may be subject to additional terms, which will be notified to you where applicable.

17. Governing Law

These Terms are governed by the laws of New South Wales, Australia. You submit to the exclusive jurisdiction of the courts of New South Wales in relation to any dispute arising under or in connection with these Terms.
